Release and Reliability Waiver
R U My Friend? Television Reality Show
Releasees: R U My Friend?, Sky Smith, the show’s affiliates, subsidiaries, successors, and assigns, and their respective officers, directors, employees, agents, and contractors (collectively, the "Releasees")
In consideration of being permitted to participate in the television reality show (the "Program"), you hereby agree as follows:
- Release of Liability. I hereby release, waive, and forever discharge the Releasees from any and all claims, liabilities, demands, losses, damages, costs, and expenses (including reasonable attorneys' fees and costs) of any kind or nature whatsoever, arising out of or in connection with my participation in the Program, including but not limited to:
- Any personal injury, illness, death, or property damage sustained by me;
- Any emotional distress, mental anguish, or other psychological harm suffered by me;
- Any defamation, invasion of privacy, or other violation of my personal or publicity rights;
- Any breach of contract or other legal claim that I may have against the Releasees.
Waiver of Reliability. I understand and agree that the Program is a reality show, and that the Releasees are not responsible for the accuracy or reliability of any information or statements made by me or any other contestant on the Program. I further understand and agree that the Releasees may edit the Program in any way they see fit, and that they may use my Likeness (as defined below) in connection with the Program in any and all media now known or hereafter devised worldwide, in perpetuity.
Grant of Rights. I hereby grant to the Releasees the exclusive, irrevocable, and worldwide right to use my Likeness, in connection with the Program and any and all related materials, in any and all media now known or hereafter devised, in perpetuity. Note: this only pertains to the usage of footage The Program collects during your time on the show.
Governing Law and Jurisdiction. This Release and Reliability Waiver shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any and all disputes arising out of or in connection with this Release and Reliability Waiver shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
Entire Agreement. This Release and Reliability Waiver constitutes the entire agreement between me and the Releasees with respect to the subject matter hereof, and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Severability. If any provision of this Release and Reliability Waiver is held to be invalid or unenforceable, such provision shall be struck from this Release and Reliability Waiver and the remaining provisions shall remain in full force and effect.
Waiver of Jury Trial. I hereby waive my right to trial by jury in any action arising out of or in connection with this Release and Reliability Waiver.
Acknowledgment. I have read and understand this Release and Reliability Waiver, and I have acknowledged it freely and voluntarily.
